Should President Trump Use Emergency Powers to Deal with The Current Crisis
Since emergencies are unforeseen and unpredictable, the powers given to the president or the government by the constitution might not be sufficient to address various crises. Besides, amending the law to take into account the situation at hand might take an extended period or do damage to principles that are considered crucial in succinct ordinary times (Jurkowski). Emergency powers give the head of state, such as the president or prime minister, a temporary boost to address the current issue until there is enough time to make relevant changes to the legislative process or the constitution. President Donald Trump should use his emergency powers to address the current crisis of Coronavirus in the United States of America (USA).
Emergency powers enable the head of state to make decisions that are meant to alleviate crises without the interruption from Congress. In other words, it is assumed that the president will always make the right decisions for his country since he has the best interest at heart. If the president declares a state of national emergency, he sets aside numerous legal limitations on his authority. For example, he can shut electronic communications, press the Internet killer switch, or freeze financial accounts of specific individuals or companies (Goitein). In the issue at hand, the number of people infected with Coronavirus has been rising tremendously in the USA. Currently, it stands at around 103,000 Americans who have tested positive and about 2,000 deaths (Regencia et al.). If the right measures are not implemented, COVID-19 is likely to kill many people since the situation will worsen when hospitals become full, and patients have nowhere to go to get proper treatment.
President Trump once said that he could declare a national emergency so that he can get funding of the border wall, which Congress failed to allocate money. As such, emergency powers enable the president to override some limitations to address the existing problem (Depetris). Other presidents in the past have used their emergency powers to help the USA overcome various challenges.
