The Contradiction in the Laws of Suspects and the 1978 Declaration of Rights of Man: A Brief Analysis Based on Adam Smith and Robespierre
In the first chapter of the Wealth of Nations, Smith argues that improvement in the productive powers of individuals, communities, or nations relies on the division of labor. For instance, in the manufacturing of nails, one man draws the wire, another straight it, and another cuts it. Adam's perception is prevalent even in modern businesses where departments specialize in different aspects of business such as legal, finance, marketing, and IT. In essence, we are different; but our differences are innately beneficial. We can only enjoy them when people enjoy the freedom to choose and specialize, underpinned by Article 1 of France's Declaration of the Rights of Man – 1789.
In contradiction to this logic, Article 2 (1) of the Law of Suspects declared suspects individuals who have shown themselves partisans of tyranny and enemies of liberty by their conduct, associations, comments, or writings. Essentially, the law considered those who disagreed with the liberty movement suspect, yet they had enjoyed their right to be born and remain free and enjoy equal rights. It, therefore, appears as though people who come in power, be it through a revolution or a democratic process, can adjust the law...
