McCulloh v. Maryland
The case involved James William McCulloh, a clerk at the National Bank branch in Baltimore. During the time, the state of Maryland imposed an annual tax on all banks without a charter. During the period, only the National Bank was not chartered. Representing the bank, McCulloh refused to pay the tax as directed by the state and sued. The Supreme Court of Maryland ruled against the case that McCulloh argued the law did not say anything regarding bank establishment and the National Bank was illegal. The issue was important because it defined the scope of the United States Congress’s legislative power and its relationship with the powers of the American state parliaments.
