Facts leading up the Dispute
Crystal Hunter Bidou (26 years), a former wife to Xavier Keone Neves (30 years) met Neves on the 26th day of September 2016 for their exchange of Cerissa at Balboa Park at 6.30 pm. The petitioner alleges that Mr. Neves harassed her in the presence of her daughter Cerissa (5yrs) and Layla (2years). The two entered into a disagreement which turned to be very verbal when Xavier questioned Crystal why she did not allow Cerissa to go for Xavier’s family trip which was organized by the sisters of Xavier. Ms. Crystal alleges that Xavier had not disclosed the relevant information in regard to how long Cerissa was going to stay away for the trip. Following the disagreement, Xavier got annoyed and started hauling abuses and verbal harassment to Ms. Crytsal in the presence of the children who started crying.
Issues
When the couple separated, the Mr. Neves was allowed to see Cerissa occasionally. However, the petitioner alleges that their daughter had been admitted for therapy sessions and was supposed to attend the sessions with the therapist. Mrs. Crystal alleges that the plaintiff did not allow Cerissa to attend the sessions when she was under his custody. This threatened the health of Cerissa who has been subjected to PTSD caused by the mistreatment by his father. Ms. Crystal asserts that Cerissa is very fearful of her father and could like to apply for an order restraining the contact between her and Mr. Neves. Ms. Crystal is asking that the father should not be allowed to see her daughter.
In his defense, Xavier argues that she was not aware of the therapy sessions that her daughter was going through and that she got to hear about the therapy from Ms. Crystal the first time on the night of 26th September 2016. Mr. Xavier defends himself that he has had a very good relationship with his daughter but agrees that they have been having issues with Ms. Xavier very often in regard to his custodial visitations with his daughter. The plaintiff denies that he has never harassed Cerissa in any way neither has he ever denied Ms. Crystsl access to her daughter. The plaintiff further argues that he has helped Cerissa in her homework severally and had filed a request to be allowed more time with his daughter on the 27th of September 2016.
