Privacy Policy in an Organization
Introduction
Before developing a privacy policy it is noble first to acquaint with the governing laws that specifically apply to a certain industry (Speed 52). Knowing all the regulations that affect the organizations, be it from federal, state, city, and county legislation will be very vital when formulating privacy policy. When deciding privacy issues, it is always wise to consider industry certifications or requirements (Speed 52). The majority of states have established constitutional or statutory laws that assure the right to privacy to their citizens (Bergen). Lack of any governing policy that protects employees from workplace trespass will lead to harassment of the personnel, especially in private companies. Therefore, employees from these companies will turn to enacted constitutional laws in order to secure their privacy protection.
General workplace privacy issues
According to Bergen the following areas relating to privacy in the workplace are protected by the federal regulations:
Physical searches
A physical search is only allowed under legitimate circumstances. For example, if an oil company records an employee stuffing barrel of oils in his/her private car without pay, the employer will be right to conduct a confined search of the vehicle (Bergen)
Genetic information
The constitution disallows employers from discriminating against their employees according to the genetic data collected. This is outlined in the Genetic Information Nondiscrimination Act (Bergen).
Medical information
Bergen explains that employers are obliged by the Health Insurance Portability and Accountability Act of 1996 to safeguard employees' health and medical information.
Drug and Alcohol testing
It is unethical for employees to come in the workplace while intoxicated, however, federal laws may prohibit the bosses from conducting drug tests to their employees. In case the tests are done, privacy must be guaranteed.
