The outbreak of Covid 19 is at the point of being classified as a global pandemic. The level of spread and severity is alarming. As a result, the World Health Organization (WHO) has called upon all countries and their governments to impose an aggressive and urgent course of action to mitigate the spread of the virus. According to the law governing human rights, every individual is guaranteed medical standards that can be highly attained. Therefore, every government is mandated to take any measures necessary to prevent any health threats towards its citizens. The law also acknowledges that in case of any serious threat to the health of the public, or any emergency that may threaten a nation, restriction of individual rights is allowed. Therefore, according to the law of international human rights, the Canadian federal and provincial governments have the right to infringe on the rights of its citizens by enforcing large scale quarantine.
The human right law states that one way to justify any restriction on human rights in this case, which may come through the imposition of quarantine, is when they have a legal basis. Its, therefore, justified in Canada since the federal government has come up with the Quarantine Act (Russell). The Act imposes mandatory self-isolation rules for any traveler to Canada and poses hefty fines as well as jail time for those who go against the law. The travelers are also restricted from making any unnecessary stops on their way home. The rule is also applicable to every person regardless of whether they are symptomatic or not; hence it’s not discriminatory in the application. The quarantine Act supports the action here to keep the Canadians safe.
