Divorce is an emotionally difficult moment for a family that is why the process requires to be done as smoothly as possible. Children are the most affected by the separation and it can stir feelings of grief, anxiety, and fear among them or worse they blame themselves for their parents’ divorce. That is why governments are involved in determining the living conditions of children after the divorce by offering custody to the most responsible parent or devising a strategy to allow shared custody. A lot of factors are put into consideration during child custody cases and this essay is meant to find out how gender stereotypes play a part in it.
Gender-warmth represents certain stereotypes that perceive and present a certain gender as caring and considerate, qualities that are taken into consideration in child custody cases. The research uses hypothetical child custody cases by collecting samples in Argentina, Brazil, and the U.S. to create a culturally-distinct sample. The aim is to investigate the role gender steriotypes play in deciding child custody.
Bias in child custody cases is an issue that has for years clouded the reputation of family courts. In Australia, this situation has created doubt in the ability of the courts to offer a fair judgment. As a result, victimized individuals mostly mothers fear to abandon toxic relationships due to worry of their child’s safety. Mothers bring life to this world, a task that requires deep devotion pain and sacrifice. They have the “natural superiority” when it comes to a child because of the relationship they share. A mother’s love has frequently served in favor of the mother with the judges seeing it fit to award sole custody of the child to the mother.
A responsible parent is more likely to opt for divorce if they can guarantee the safety of their child after trial. That means winning the custody case but there some laws that make the process difficult. According to the Family Law Amendment (Shared Parental Responsibility), Act 2006 in Australia, mothers and father’s rights do not exist and the main objective is to come up with a solution that benefits the children. The lack of preferred treatment according to family laws creates a competing idea that goes against the research puzzle meant to determine the role of gender bias in the judgement of child custody cases. This report is meant to determine the influence of gender bias in deciding child custody cases. Gender bias in this instance is measured by “gender warmth” which represents the bias afforded to gender with the good parent status. The research involves exposing participants to two cases that portrayed one parent as the more deserving of winning custody of the child. There will be two versions in that the roles will be reversed in each case to ensure that each gender gets to be portrayed as the good parent in each of the cases.
