Mediation is an Alternative Dispute Resolution (ADR) whereby differences of either two or more parties are resolved and there is a fair agreement reached even though this mediators lack the power to make any decision. In case the parties involved seem not to agree then those agreements made determines whether the mediators will modify the case or jointly recommend the court to modify the case. Human services has got its objectives of meeting the human needs through the interdisciplinary knowledge base, as they focus on prevention not leaving behind remediation of problems and maintaining a commitment so as to improve the overall quality of life of service population. These essays critically, explore the existing integration of mediation and advocacy within a human services agency on a national or international level.
For instance the case of child abuse, it means an Alternative Dispute Resolution (ADR) is used and some developed policies and practice in relation to ADR when settling for such cases in question when they arise. All this happen fewer than two frequently used processes that are the family group conferencing and the mediation. Other ADR`s are those meetings organized concerning the court hearings that are the role of Family Consultants in the Family Court and the ADR processes developed for Indigenous families like the Care Circles. Through this kind of approaches, the congestions in the courts handling the child abuse cases will reduce and there will be some cost saving which are normally associated dealing with relationships of power; protection from violence, abuse and intimidation, and ensuring that all voices heard, including the voice of the child (Kathleen, 2003).
The importance of mediation in solving ADR in child protection cases is because there is hope for the problem to get the solutions needed about the care and protection of the children. According to North Carolina Administrative Office of the Courts. (2010) it also improves the communication between the many agencies like Child Abuse Prevention Association (CAPA), Administrative Office of the Courts (AOC), Center for Families, Children & the Courts (CFCC) and those individuals involved to make the decisions needed when it comes to child protection. In addition, they give each side a chance to express itself by airing there views.
Despite the importance they get, ADR in child protection matters does encounter its own challenges when it comes to family violence which are dealing with relationships of power; protection from violence, abuse and intimidation; and ensuring that all voices are heard, including the voice of the child. Training of conveners and ensuring best practices will help solve these kinds of challenges.
