The issue of the United States' reluctance to join the ICC continues to be a matter of international debate. This week's discussion requires you to take a position on whether or not the United States should formally join, and accept the jurisdiction of, the International Criminal Court. In this discussion, avoid notions of jingoism, and examine the international community and the responsibilities of the United States as an international actor in both civilian and military affairs. Established in 2002, the ICC had a purpose of ensuring that mass atrocities as well as crimes against humanity are not committed with impunity. National governments have proved not to have the capacity to deal with mass atrocities over the past years. In such occasions, the international community has been known to come in handy to salvage the situation. The function of ICC is to serve prosecutions in situations where a national government does not have the capacity to do so or on the basis of a directive from the UNSC. America is not a member of the ICC, but it has been on the forefront of supporting the course of the Criminal Court.
The reason why the US is not a member is because it wants to protect its political leaders as well as military personnel who are most likely to be victims if they sign the Rome Statute. The Court does not prosecute governments or institutions; rather it prosecutes individuals with the help of specific nationals.
