For many years, the countries of the world have existed with uncontested sovereignty- more or less as a natural way of norms, save for the past few decades. The current, as well as the past few generations have witnessed trends in the decreasing nature of nations being autonomous because of the mounting ideologies of globalization and international law for that matter (Scott, 2004). Aside from developments in international law, there have been notable advances in aspects such as the internet, global television, monetary unions and non-governmental organizations as well.
All the same, whenever the subject of international law and state sovereignty is under question, one is most likely to hear the mention of the International Criminal Court (ICC). In 1998, a great deal of world nations opted for the idea of the establishment of this court under the Rome Statute. This has been considered as a major step towards the enhancement of international law, specifically after the Nuremberg and Tokyo conventions and or proceedings, which were initiated after World War II. In this regard, it is worth mentioning that the United Nations (UN) has also played a role in the ratification of International law (Scott, 2004). As such, this paper strives to point out that international law, in its worth and scope has notable contribution to global governance, and that the principle of sovereignty does not entirely render international law. In spite of everything, it is however, safe to acknowledge that unwillingness of some powerful nations and or states to cooperate fully in the application of international law has acted as a major blow to the whole concept of Global governance in a concrete sense (Reus-Smit, 2011).
The truth of the matter is that the capacity of international law to influence the affairs of sovereign states, even among the developing nations, is exceptionally limited (Teitel, 2002). On the other hand, it stands out as an equally important object; the fact that today, States’ jurisdictions in terms of how governments treat their citizens (mostly with regards to human rights) remains a matter of scrutiny by function of international law (Scott, 2004). However, one cannot decline to note that conventional international law was designed to govern the relationship between separate states on the global platform (Teitel, 2002).
It is well acknowledged that international law is supposed to function within state-based legal systems and the common fact that sovereign equality of nations ought to be maintained.
