It is increasingly becoming unsafe to share personal information over the internet with the rise of hacking and cybercrimes. Unfortunately, technological advancement is undeniably making it difficult not to utilize the internet. It feels comfortable with the easiness to do things from a mobile app, however, the same comfort drives the fear of being hacked. The same fear drives the criminal justice system when dealing with cybercrimes. The anonymity characterizing the crime scene makes the identification process of criminals difficult. Several services mask user’s IP address and identifying online users would result in more exploitation of people’s rights and privacy CITATION Coo11 \l 1033 (Cooper, 2011). The risky nature of the crime also puts the police or investigators at the same position as the hackers in regard to violating privacy conditions of individuals.
The fragile nature of evidence also poses the fear of pursuing cybercriminals. Moreover, cybercrimes may take place from anywhere in the world. Jurisdiction issues vary across states making conviction of hackers challenging. In essence, the criminal justice systems perceive hackers as a threat to society yet solving the threat creates more problems. Also, the law enforcement agencies have to keep up with forensic techniques and new technological development to be at par with hackers’ schemes.
