Federal Legislation
Through the establishment of the National Labor Relations Act in 1935, the federal government allowed the formation and organization of unions. The law provided employees within the private sector with fundamental rights (Frymer, 2003). They were also allowed to form trade unions, participate in collective bargaining, and strike if necessary. After the passing of the NLRA, a National Labor Relations Board was formed. This board would help ensure that the rights of employees under the NLRA were observed. Hence, the NLRB would oversee the prosecution of employee rights violations. Also, the board would oversee the employee’s decisions to be represented by labour organizations. In essence, the NLRB would police employee-employer relationships, and make sure the NLRA was enforced (Frymer, 2003).
