The duty of loyalty in whistleblower cases is of corporations. The loyalty is owed to the citizens and it’s the duty of Government to show the greater duty of loyalty. In Citizens United v. Federal Electoral Commission the Court as an arm of government overruled the Austin case because it thought it unreasonable to ban corporations from the freedom of speech. Corporations have a duty to serve as a check and balance to the government and ensure public welfare. In the case, the Supreme Court acknowledged that censoring corporations would deprive the electorate of opinion, knowledge and information that advises voters about which entities are hostile or favorable to their interests CITATION CIT10 \l 1033 (Citizens United v. Federal Electral Commision, 2010).
