The state secrets privilege and the USA Patriot Act are both important laws in the United States. You may be familiar with the USA Patriot Act. Congress enacted it after the terrorist attacks of 9/11 to advance national security and ensure American safety against terrorism. The state secrets privilege is a much older law. As early as 1875, the federal government used the state secrets privilege to address matters of national security. The federal government may invoke the state secrets privilege when the president believes it is necessary to do so. In the wake of the war on terrorism, the federal government increased its application of the states secrets privilege to address terrorism.

For this Discussion, you explore a Supreme Court case involving the use of the state secrets privilege in the war on terrorism. As you review the case and enter into the Discussion with your colleagues, be prepared to state your position on the use of the state secrets privilege secrets in the war on terrorism.

Terror and the Law
After the disaster that took place on 9/11, the country has been on high alert for activities of terrorists’ cells operating on the home soil. With threats, such as the Boston bombing, the fight against terrorism has not been easy and the homeland security along with security agencies have been working around the clock to make sure there are no repeats of such activities. Much of the efforts has been at the making sure there are no terror activities in the countries of origin such as within the middle east. The other front the government has been fighting terror, is through legislations the enhance the agencies’ ability to track down terrorists and their activities in and out of the country (Los Angeles Times, 2011). The two main legislations that have been involved in the fight against terror are The State Secrets and the Patriot Act. However, this has not been without significant concerns.
In brief the State Secrets Privilege is a common-law privilege that was first used in England, allowing the Kings and Queens the right to withhold information from the judicial system, deeming the information was a threat to national security (Center for Constitutional Rights, 2007). In the unites states, the SSP is used by the government to get the chance to withhold any evidence and even dismiss cases which challenge the administration within the US courts. The Patriot Act also known as the Uniting and Strengthening America by Providing Appropriate Tools Required to Intercept and Obstruct Terrorism Act, relates to conducting surveillance and getting access to personal and sensitive information in the quest to fighting crime through collecting information to build a case against the suspects (Department of Justice, 2017).
In a country that prides itself in the foundation on democracy, these two legislations have attracted the most criticism from the public and the scholarly realm.
