The case of Korematsu against the United States characterizes prominent cases to be referred to the judicial system of the American people. President Franklin Roosevelt, created an executive order, 9066 that authorized the military commanders to prescribe over areas where they decide on the exclusion of individuals or groups of people in the act on 21st March 1942. The Western defense commander general exercised the authority of the order to remove and detain Japanese ancestry citizens and immigrants in central assembly centers and camps (Legal Information Institute, 2017). Without any charges laid upon them, the Japanese were incarcerated without trial and any legal processes that deemed to be against humanity and democracy. Despite the government decision makers not having any evidence to support their actions, they continued with the eviction process.
In 1994, the Supreme Court in the case of Korematsu and the United States upheld the potent eviction of approximately 120,000 individuals from their residence in the West Coast during the Second World War. Inclusive was 70,000 already permanent U.S citizens, evicted to camps in the western states. The move was in a bid by the military and government to prevent sabotage and espionage resulting from loyalties of the Japanese people to their country of origin. The Supreme Court vote ruled in favor of conviction of Korematsu. (Legal Information Institute, 2017).
