To suppress the activities of terrorist organizations, law enforcement authorities have implemented stringent measures and prosecutable offences on individuals or organizations that provide any form of material support to terrorism. According to Abrams (2005), any individual who gives resources or material support to a foreign terrorist organization, or conspires or attempts to do so, will be prosecuted under this title. This can include a fine, jail term not exceeding 20 years, or both (Abrams, 2005). In case such an activity resulted to death of any individual, the culprit will be prosecuted for any number of years or up to life in prison. This paper critically analyzes the prosecutable offences associated with supporting foreign terrorist organizations.
For an individual to be prosecuted, he must have violated the 18 U.S. Code § 2339A or 18 U.S. Code § 2339B that are concern with offering resources or material support to terrorists (cornell.edu, n.d). In addition, such an individual should have had the knowledge that the organization has been designated as engaging in terrorism activities (cornell.edu, n.d). There are a number of laws and regulations that classify the functions and activities of terror organizations. For instance, legislations on terrorist activities may be prosecuted under the Immigration and Nationality Act, the Foreign Relations Authorization Act, or the Patriotic Act. The U.S. government has also implemented current laws aimed at curtailing the activities of terror organizations, particularly after the recent 9/11 terror attacks that led to the death of close to 3,000 people (Breinholt, 2004). In addition, funding of terrorist organizations has been blamed for the rapid rise and spread of terror activities across the world.
