The United State's fourth amendment protects the citizens from “unreasonable” search and seizures. It allows for such if and only if they are based on probable cause and a warrant. A warrant is a signed paper by a judge that gives law enforcement officers permission to enter a home or building to search or make an arrest (The American Liberty Union, 2008). Search Warrant allows the officers to enter, look for, and takes identified items. An arrest warrant allows officers to take you into to custody. Just as the search warrant alone does not allow the officers to arrest you, the arrest warrant alone does not allow the officers to search your residence (The American Liberty Union, 2008).
In relation to probable cause, a search warrant can be issued where a judge finds probable cause for the search and arrest. Probable cause hearing is required where the individual being charged with a crime that carry a potential life system. Probable cause occurs where the known facts and circumstances are enough to warrant an individual liable for a certain accusation of murder.
John Heath was arrested for the alleged murder of his wife Elizabeth Heath in 1984. In 1984, there was no evidence at the initial arrest and, therefore, no reason to arrest him as the case was circumstantial and no incriminating evidence to allow his arrest. However, two years ago Elizabeth Heath's skeletal remains were found under a barn at their former residence in Newton CITATION Pir12 \l 1033 (Pirro, 2012). None of the police officers, friends, and neighbors called as witnesses could strongly testify and directly link Heath to the murder of his wife CITATION Pir12 \l 1033 (Pirro, 2012).
