The Miranda vs. Arizona case (1966) is a landmark case pertaining to custodial interrogations and drastically changed the way police approach interviewing suspects. In this assignment you will summarize the facts of the case. Follow the steps below to complete this assignment.
First, using the FAU library, or any other source to locate a resource that provides the facts of the Miranda vs. Arizona case (1996) and the Supreme Court’s ruling. Then, write a detailed summary including the following:
What happened?
The progression through the court of appeals, and what the Supreme Court ruled.
Based on the Supreme Court ruling, explain how law enforcement now handles the “Miranda” warning.
What must be told to people being interrogated for the “Miranda” warning to be valid?
Can a subject invoke their Miranda right just by remaining silent? Once invoked, can officers reinitiate questioning?
Conclude by explaining if you believe this to be an important right and if the Supreme Court’s decision was the correct one as it relates to effective procedural justice.

Even though most people have heard about Miranda v. Arizona (1966), many did not have finer details of what transpired. The case involves Ernesto Miranda, arrested by police on March 13, 1963, on the charges of kidnapping and rape in Phoenix, Arizona. However, during this time, the police did not inform Miranda of his constitutional right to have an attorney. Moreover, they did not notify him that he had a constitutional right against self-incrimination. Despite failing to be informed, Miranda signed a written confession affirming that he fully knew the following rights and admitted to having committed these crimes.
The following confession played a huge part in his June 27, 1963, conviction. Judge McFate sentenced Miranda to a maximum of 55 years, depending on this evidence. He later appealed the case through his lawyer Alvin Moore to the Arizona Supreme Court, reaffirming the decision. At this point, the court ruled that the police did not violate any constitutional rights by procuring him where there was no lawyer.
Later on June 13, 1966, the Supreme Court offered a different ruling. The court ruled that bringing the following confession as evidence violated various constitutional rights, which have been documented in the 5th and 6th Amendments. For example, the 6th amendment gives the suspect the right to access a personal or a state attorney (Logan, 2019). On the other hand, the 5th amendment usually protects any suspect from any instance of self-incrimination. The police must explain to the detainee of their rights.
