Malpractice Case: Surgery: Iturralde V. Hilo Medical Center USA
Case Summary
The case concerning Iturralde v. Hilo Medical Center was decided by the Intermediate Court of Appeals of Hawaii on March 30, 2012. Iturralde, the plaintiff, within this case, sued Hilo Medical Center and Dr. Robert Ricketson because of medical malpractice, which made the plaintiff get exposed to some health risks. According to Iturralde, the medics acted unprofessionally since the screwdriver shaft was implanted inside his spine. The plaintiff was later diagnosed with the condition that needed a spinal fusion surgery called Spondylolisthesis L4-5 with stenosis that is degenerative.
Ultimately, in 2001, Iturralde perished two years after the surgery. This resulted from the doctor utilizing the shaft after noticing that the titanium rods needed for the surgery were missing. The screwdriver shafts broke after being put in the plaintiff’s back, resulting in more surgeries later on. Dr. Ricketson did not accept that the care level he offered was substandard while in court. The case was considered a negligence case, and Ricketson was held accountable for the death of Iturralde after the implantation. The court decision was that the hospital pays around $3.5 million in terms of punitive damages and $5.7 million to Iturralde’s household.
Medical Malpractice Component
Based on this case, the doctor was mandated to practice a legitimate obligation by complying with the proficient principles set out. The doctor ought not to make any choice that might have caused danger to the plaintiff’s health; this could have displayed professionalism. Confirming whether all required operating apparatus are available is part of a surgeon’s legal duty before carrying out surgery of any kind; Dr. Ricketson failed to do that (Zabinski, 2020). The subsequent cause of the patient’s demise is believed to be the doctor’s negligence.
