Jack's attorney moved to dismiss the charge of the attempted murder of Bert on the ground that Jack could not have killed Bert due to the malfunctioning of his gun. the court g5ranted the motion to dismiss the attempted murder charge. Liability law points to the legal framework that is usually associated with the legal responsibilities for one’s acts or omissions. One should always own up their responsibilities or their acts failure to which may lead to a lawsuit for any resulting damage. In this context, therefore, the court was very wrong to dismiss the charges against Jack, who should have owned his intentions of killing Pratt. The law underscores this fact by stipulating that a person is legally liable when he/ she is financially and legally responsible for something. This law concerns both civil as well as criminal law. It is, therefore, an offense to evade a liability dishonestly.
In the case of a breach of contract that is legally referred to as the violation of statute, the plaintiff must prove the legal liability of the defendant if the plaintiff’s allegations are shown to be true. Broadly speaking, this requires evidence of the duty to act, failure to fulfill that particular duty and the consequent connection of that failure to some injury or harm the plaintiff. Though in this case Jack was aiming to shoot Pratt, his ill intentions led to the death of an innocent part which culminates in an alleged criminal act which the defendant may be responsible for his/ her subject to conviction and punishment. For instance, though Jack initially targeted Bert, he ended up killing Pratt, that is criminal. The lawsuit should be looked at as twofold; attempted murder and the real killing committed by Jack (Sullivan, Arthur &Steven M.She 2003).
Under the law, Jack is guilty and should have accepted the charges. It is only considerate and logical that a lawsuit should be brought against him based on the law statute. Any act contrary to this automatically leads to breach of the law.
Though Jack’s attorney dismissed the charge on the ground that the gun malfunctioned, Jack had bad intentions of harming Bert actually. This amounts to a criminal act that should punishable by the law. It was so wrong of the court to dismiss the charge since it has a heavy hand of crime in it which in one way or another is perilous. Attempted murder is a scandalous offence especially for the purposes of provisions of the Justice Act 2003. The court should have considered one of the sentences for public protection prescribed in the very act. This is simply to protect the interest of the public from Jack, who apparently had become dangerous. For him to continue living among the people is a mockery of the greatest order since for once...
