This patent can be used to prevent other people and companies from manufacturing devices protected under the patent claims. This patent outlines a motor control strategy for the Segway and claims IP surrounding this technology. Say, for instance, a three-wheeled personal mobility device has come on the market with wheels in a triangle formation. This device is different in that it detects open motor winding in the one front wheel and uses that feedback in its motor control algorithm. Do you think this could be in violation of the Segway patent? Prepare an analysis in which you argue if you think this device could be in violation of the Segway patent and why (or why not). Possessing a patent for a particular product does not guarantee that there will be no infringers, especially if the owner is not willing to take stringent actions against the violators. The patent is worth as long as the owner is willing to spend both the time and resources to defend it. In this case, the new product is a personal vehicle intended to carry one person just like the Segway Personal Transporter (Segway PT) (Len.Org, 2001). The intention of the new company is to manufacture a motorized wheelchair to help individuals with partial or total walking disability resulting from various medical conditions. This is the exact service Segway PT offers and the new product could present stiff competition to Segway Inc. Although the intention of the new company could be the same as that of Segway Inc., the design of the new product is different from Segway PT. As such, I do not think the new company is violating Segway patent US6302230 B1. According to the patent's claims, the Segway PT has an automatic balancing system that functions depending on the position of the person on-board (Tweney, 2009). On the other hand, the new product intends to use three wheels to increase the stability of the passenger, meaning there is no need for an automatic balancing system. Even though both vehicles have a platform to support the passenger, the new one has no ground-contacting module that also plays a crucial role in maintaining balance.
