We will discuss this assignment, including draft submission procedures, in more detail in class as the semester progresses.
6. Your paper is due in class on Friday, April 24, 2020 in hard copy form. Late papers will be assessed a full one-letter grade penalty. Discrimination in the workplace can be examined from the prejudice and bias that occur when an employee is treated unfavorably and differently from other workers because of his gender, religion, race, and disability, among other various factors. It is crucial to comprehend that it is unlawful for an employer or company to treat individuals differently because of their distinctive characteristics. Ideally, the Equal Opportunity Act 2010 outlines numerous personal characteristics that make employment discrimination illegal; these may include physical features, political beliefs, race, sex, age, and sexual orientation. With the increase in cultural and gender diversity in the workforce, the topic of workplace discrimination has become of public interest. Employers and organizations have the responsibility to ensure that their workers are protected from any form of discrimination and unfair treatment while the workplace; this is possible by promoting diversity where every worker feels accepted and respected. This literature provides a summary of workplace discrimination, conducts a historical analysis of this issue, evaluates relevant cases that are essential to workplace discrimination, and offers an opinion about the future of this issue.
Summary/description of the legal topic
The Equal Employment Opportunity Commission (EEOC) is mandated with enforcing the anti-discrimination laws in the workplace. Ideally, discrimination can be exhibited in various stages in an organization; for instance, during recruitment, an individual may be denied the opportunity to work in a company because of his or her beliefs, religion, and political alienation, among other different factors. Besides, individuals already employed may also be unfairly treated when they are denied equal promotion opportunities like other workers, and when they get poorly paid (Bobbitt-Zeher, 2011). Besides, discriminations would also involve harassing behaviors where employees are likely to experience uncomfortable interactions with their co-workers, managers, and clients within the organization.
Additionally, employees can file a complaint against the company or the employer when they are discriminated against or when they are harassed by other parties while working in the company. The filing of a complaint is necessary when the employer disregards the complaints made by the employee and fails to implement mechanisms to prevent further harm. Employees have the right to feel protected when working in an organization; the employer has the legal responsibility that a suitable working environment is created to ensure that all individuals in the organization are protected (National Conference of State Legislatures, 2019). Moreover, employers have a role in preventing unwanted behaviors within the workplace, and this can be achieved by developing policies and guidelines that all employees are required to a bid, and individuals who disregard the guidelines may be subjected to disciplinary actions. Companies and employers who fail to stop discrimination can face lawsuits, fines, and criminal penalties.
