Although inmates do not enjoy full constitutional rights, the constitution still protects them against cruelty and guarantees certain rights. According to the permeable to the United States Constitution, prison inmates have certain pertinent rights and special circumstances which, among other things, can enable an inmate to challenge his or her confinement. The purpose of this paper is to examine the legal mechanisms in which an inmate can challenge the confinement and possible costs that can accrue to the state or federal government from such move. It shall also peruse management issues that could arise in prison as a result of guaranteeing pertinent rights to inmates with special needs and such concerns can be handled. It shall also verify if the use of supermax housing amounts to the cruel and unusual punishment which the Eight Amendment of the Constitution is meant to protect the inmates against (Reiter, 2014).
There are some legal mechanisms in which inmates can challenge their confinement. Eight Amendments provides the basis for the inmates to challenge inhumane conditions of their confinement that can amount to cruel and unusual punishment (White, 2014). The law also guarantees the inmates to complain about prison conditions and should be allowed by the courts to air their complaints (White, 2014). Disabled prisoners derive grounds for challenging their confinement under the Americans with Disabilities Act which enables them to access facilities that they qualify for. Also, First Amendment rights enable the inmates to challenge their confinement their rights such as freedom of speech are denied yet are guaranteed in the amendment. Inmates are also entitled to adequate medical care and good sanitation facilities (White, 2014).
When the inmates challenge their confinement, there are various costs that arise from the programs such as medical care and provision for special facilities for people with disabilities (Champoux, 2016). These costs should be catered for by the inmates and not the state or federal government. This is to teach the inmates a lesson by having them pay for the costs of their crimes (Champoux, 2016). The costs can act as a deterrence to crime. The inmates should pay for the consequences of their wrongdoing because if the costs are covered for, people will commit crimes so that they can go to prison where the government can cater for their expenses (Champoux, 2016).
