The first amendment of the constitution of the United States offers protection to freedom of expression and also freedom of religion‚ from being interfered to by the government. The right to freedom of speech is the most fundamental component of freedom of expression. This right gives any individual a chance to fully express themselves without being constrained or interrupted by the government. The commercial speech has had a great transformation with the first amendment‚ that is‚ from extreme non-protection to the protection that is qualified (Shapiro, 2011).
The First Constitution Amendment of the United States states that the congress shall not be allowed to make any law abridging to freedom of speech. Due to disparities about the true meaning of freedom of speech‚ constitutional clauses does not reference their original meaning. This has made the Supreme Court develops its own set of unprotected and protected speech. The first guarantee is that which addresses protection against any government actions‚ but not against actions with regard to private individuals. Secondly‚ is the guarantee that it applies to both the federal and state levels. The other is that the speakers are covered irrespective of which medium it is‚ whether it is the internet‚ book or the magazine (Shapiro, 2011).
Freedom of speech clause entails the actions meant for expressing oneself such as the actions fundamental for one to deliver an effective talk‚ an example is that which entails buying of a podium‚ wearing a flag or any critical symbol are also examples. The speeches about religion‚ sciences‚ art‚ political speech‚ and a series of many other essential topics are also protected. The amendment also defines free speech as that which extends to all viewpoints‚ even ones that are considered evil by the society.
There are some limitations, however, to the freedom of speech. They include speech that acts as a way of inciting individuals to break the law‚ violent threats‚ and the fighting words, which are often directed to specific individuals and can result to fights.
