Federal and State Government in Implementing Criminal Justice
The United States is made up of state and federal governments that work in collaboration in order to protect the well-being of their citizens. The work of the federal government is defined in the USA constitution, which comprises: border defense, foreign affairs and many more activities. On the other hand the state governments have their own role and work established in their constitutions. Each state is governed by its own laws, but they cannot have rules that conflict with national laws. In both the governments they have three arms of governments, namely: executive, judiciary and the legislature (Rushefsky, 2013). Each has a different role to play in the running of the government and their powers and responsibilities are stipulated in the constitution. The reason of having state governments is because the USA is a large nation and the federal government cannot run the activities of the government alone. Therefore, the activities of the criminal justice can be done by the state government with some assistance from the federal government.
Difference of Federal and State Government When Implementing Criminal Justice Policy
The federal government when implementing the criminal justice policy deals with criminals that have violated laws at the national level. These crimes may include: bankruptcy, terrorism, cybercrime. These crimes are dealt with in the federal judiciary system, regardless of the state where the crime occurred. On the other hand the state government enforces justice on criminals that have violated the law on the state level. Some of the crimes may include: robbery, rape, assault and many others (Ross, 2014).
According to the national constitution, there are different sectors that work together to administer justice in the United States of America. There are some rights the state government has over the federal government. Therefore, the state can administer some laws without the interference of the federal government. The law enforcer in the state level comprises the local, county and the state police. While in the federal government the primary law enforcers are the FBI. Therefore, most of the prosecution and crime legislation are done at the state level, whereas the federal government can help the state in the construction of the prison and provide other infrastructure to bring the culprits into the books.
The federal and state governments have different courts which serve in the different jurisdiction. Therefore, a crime done in a certain state is dealt at that state and the federal government has no power to overrule a decision passed by the state judiciary. However, the federal government can intervene when the right of an individual is violated by the state government. This is because the federal government has a right bestowed on them by the constitution to safeguard and guarantee all the citizens their rights. For example, the fourth amendment protects American citizens against unreasonable search and seizure and the eighth amendment protect citizen against cruel and unusual punishment.
