Commerce refers to the exchange of goods or services for money or in kind, usually on a scale large enough for transportation from one place to another, across city, state or national boundaries. In the U.S, the Commerce Clause gives the congress the power to regulate with foreign nations, within the several states and with the Indian tribes. It is found in the Article 1, Section 8, and Clause 3 of the US constitution (Francone, 2016).
The Commerce Clause is used to regulate business both at federal and state level. The Tenth Amendment states that any powers not delegated to the congress by the constitution are reserved for the states. The states are deprived of all the power to regulate interstate commerce, since the congress has the exclusive power to regulate commerce.
