Case Number: 1111111 Date: 13 August 2016 Reporting Officer: Colt Winchester Incident Type: Crime Against the Person Address of Occurrence: 111 Felony Drive, Happy Town, GA 15486 Witnesses: Alan Skittles: Store owner. Male, 43, Latino Michael Smith: Employee. Male, 21, African American Andrea Sianturi: Customer. Female, 27, Asian American Weapon/Objects Used: Umbrella / Shoe On August 16, 2016, at approximately 20:43, officers responded to 111 Felony Drive in regards to a white male bleeding from his face. The victim, Samuel Clark, was friends with a female, Summer Breeze, who lived at 111 Misdemeanor Lane. Mr. Clark was walking to Ms. Breeze’s residence approximately one block east of Mr. Clark’s residence. As Samuel Clark turned the corner, he observed two white men approaching him. A witness, Alan Skittles, identified the two men as Bubba Hurt and Skeeter Redrum. Both Bubba Hurt and Skeeter Redrum began yelling at Samuel Clark for him to leave Summer Breeze alone and that it was the “last time he put his hands on her.” It began to rain so Samuel Clark opened his umbrella and continued to walk north on Felony Drive. Bubba Hurt shoved Samuel Clark from behind causing Samuel Clark to fall to the sidewalk. When Samuel Clark began to pick himself up from the sidewalk Skeeter Redrum kicked Samuel Clark in the face causing Samuel Clark to fall onto the street. While Samuel Clark was lying on his back in the street Bubba Hurt began to kick Samuel Clark. In response, Samuel Clark grabbed his umbrella and swung, hitting Bubba Hurt in his eye. As Samuel Clark stood up Summer Breeze hit Samuel Clark in the side of his head with her shoe rendering Samuel Clark unconscious. A witness to the incident contacted 911. Samuel Clark and Bubba Hurt were taken into custody and transported to the hospital. Summer Breeze and Skeeter Redrum were taken into custody and transported to the Police Headquarters. Assault is a violent crime. Many states classify assault on the basis of severity whereby simple assault is chargeable as a misdemeanor whereas aggravated assault is chargeable as felony. One does not have to utilize a weapon to be charged with aggravated assault. Beating someone fists or kicks several times to cause serious concussion, disfigurement and broken bones will make one get charged with felony. Weapons utilized can be very simple like pencils as long as it injures someone.
As the District Attorney, Bubba Hurt and Skeeter Redrum would be charged with verbal assault as they yelled and aggressively used words to attack Samuel Clark. They told him if he did not leave Breeze alone that it would be the last time he put his hands on her. Samuel Clark felt threatened and continued walking north. Bubba Hurt and Skeeter Redrum carried out the threat and this caused fear of approaching danger on Samuel Clark. If the words were only spoken but not acted upon, then there may not have been an assault. But, the words were accompanied by actions which put Samuel Clark in reasonable fear of approaching harm.
Further, Bubba Hurt, Skeeter Redrum and Summer Breeze are charged with battery. The three intentionally, offensively and harmfully touched Samuel Clark without his consent. They had an intention of battering him since they had verbally passed their intent (Atoki, 1995). In the end, they caused significant physical harm and visible bodily harm to Samuel Clark since he suffered a permanent brain injury.
Additionally, Bubba Hurt would be charged with both simple and aggravated assaults. He pushed Samuel Clark from behind to make him fall on the sidewalk. Also, he kicked Samuel Clark while he was lying on his back on the street. Similarly, Skeeter Redrum would be charged with aggravated assault for kicking Samuel Clark on the face and making him fall onto the street. The kicks might have caused a serious concussion, disfigurement and broken bones. Summer Breeze would be charged with aggravated assault for hitting Samuel Clark in the side of his head with her shoe and rendering him unconscious.
Samuel Clark could also be charged with aggravated assault and manslaughter. He utilized a weapon as simple as an umbrella that caused serious bodily injury and death. He hurt Bubba Hurt’s eye and this might have been a disfigurement. Also, Bubba Hurt’s death would prompt Samuel Clark to be charged with murder.
