SCENARIO # 1: An Unannounced Inspection The Situation: An OSHA inspector arrives at your worksite requesting to talk with you about an inspection based on the health and safety complaints of a worker. You are in your office and the OSHA inspector is at the reception office. You know this worker to be a highly disgruntled individual who is constantly questioning all aspects of his job and the work environment. The area he works in is currently undergoing a major renovation for a process change for the product in the line, but it is still trying to produce the older version of the product at a lower volume than before. Your area supervisor is a competent individual, but he or she is working under a lot of stress with the changeover; therefore, you are only 80% sure that the claims listed in the complaint are groundless and without merit. The worker is also heavily involved in an effort to unionize the plant employees. In addition, your plant manager is in another state at corporate headquarters for some important meetings. 
The Questions: How would you act, what actions should you take, and what would you do? Should you challenge the validity of the OSHA inspector's request or their right to enter the workplace? Or should you request a warrant to enter the workplace and thereby gain some time to make sure everything is in order back in the plant? Can you gain any time to check with your in-area safety supervisor first? Or should you immediately comply with the request for the inspection? Explain your answers.

The Inspection Process
It is important to carry out workplace inspections because they help in identifying and preventing injuries and illnesses to the workers. It ensures the health and safety of the employees thus enhancing their welfare (Haviland et al., 2010). OSHA is a body that is entrusted with the mandate of inspecting the workplace situations and giving the recommendations on how the situation can be improved. The body listens to the complaints of the employees, identifies the potential and existing dangers at the workplace and advises the company on the appropriate measures to take. In the case study, the unannounced inspection is as a result of the complaint that was aired by one of the employees to the inspectors about the condition of his workplace. One should be very careful in dealing with the OSHA inspectors and unless they are fully aware of their responses they should let someone else who is well acquainted with the OSHA regulations do so. In addition, they should notify the company’s attorney so that they meet with the inspectors in the presence of the attorney (Weil, 2001). The company or employee representatives have the right to accompany the inspectors in their work and explain any inconsistencies. There may be cases of impersonation of the inspectors thus it is important to ensure that one is dealing with genuine inspectors by requiring them to show their credentials. It is also advisable to write down the credentials of the inspection officers. Once the credentials of the inspectors are confirmed, they should be allowed inside the premises.
