There are chances that Deb could win the case if she presents the right evidence. Among such evidence is if Deb was not able to get the flu vaccination due to medical or religious reasons. It will also build a strong case against the hospital if no one bothered to determine why Deb did not take the vaccine. Another chance of Deb winning the case is if she was not given enough time to take the vaccine. Another evidence that would help Deb's case is if she belonged to a union that allows medical practitioners to have options on whether to get the flu vaccine or not. Some scholars believe that vaccinating healthcare workers does not prevent or reduce flu cases, and therefore, medical practitioners can choose not to get vaccinated (Lukich, Kekewich & Roth, 2018).
One of the laws protecting the hospital regarding the hospital mandated vaccination procedures is the support for the influenza vaccine. The National plan for preventing all infections associated with healthcare supports flu vaccination aim to protect patients and workers' healthcare (DeYoung, 2019). Such helps in the reduction of medication costs associated with flu. The flu is a very infectious disease, and if one of the healthcare workers has it, it could easily spread to other workers and patients. Supporters of the flu vaccination claim that it is ethical for every healthcare worker to get vaccinated.
There are low chances that Deb will win the case. The hospital has a policy that every healthcare worker should get the flu vaccine. In that case, the policy must have been made clear to Deb during her employment. The hospital will justify that she was employed at-will, and therefore, her termination is justified. However, in the case where Deb wins the case, the hospital's impact will depend on the reasons she won the case. For instance, if Deb did not get vaccinated due to medical or religious reasons, the termination could be deemed wrongful. The hospital should then be worried since it will have to fairly compensate the employee. It will also come up with policies to prevent such cases from occurring in the future.
If the case is a success, the health care center will be obligate to review its policies to protect its employees and patients. The flu is contagious, and if some of the employees choose not to get vaccinated, it could be a health concern to the hospital.
