The digital locks rule implies the implementation of digital systems that prevent copyrighted works from individuals that wish to make copies (Government of Canada, 2012). The bill seeks to dis-allow the making of copies for more than the suggested times legally.
On the other hand, bill c-11 aims to create new measures for the reproduction of copyrighted material y individuals for their gains. The excerpt below seeks to compare and contrast some of the differences between these two laws (Government of Canada, 2012). Additionally, the paper will look at one case law that would be relevant in explaining the distinct differences between these two laws.
Digital locks have been used for some time by the gaming fraternity to prevent the piracy of their video games. However, the implementation of these laws in other media is rare, and Bill c-11 seeks to introduce the locking of digital material through digital locks that prevent third parties from accessing locked content and making copies (HICKS., 2009). The digital locks law has come under immense speculation in recent times for some of the clauses in the law that seem to hinder the public's interest in enjoying some digital content. Some of the most significant provisions are as follows; the bill will supersede some of the substantial rights that citizens should enjoy under the copyright act (Sharma, 2018). This is because the action prevents circumventing a TPM and further makes it illegal to use circumvention tools that may be vital to citizens to use software without the need to infringe on the existing copyright laws.
The bill would further become detrimental as some of the consumers primarily in the United States would often wish to make copies of their legally purchased software for their personal uses such as employment on different devices such as their phones, laptops and other devices they would wish to view their content on at other times.
Bill c-11 makes the manufacturing of the software necessary to make copies of DVD's illegal and this has prompted numerous lawsuits against companies that manufacture such software (WINSECK, 2018). Additionally, although the bill contains some exceptions for the purposes of making copies, the exceptions do not cover all legitimate reasons for consumer who wishes to make copyrights of their favorite produced material (HINZE & SUTTON, 2012). Additionally, the lock limit creativity as they prevent individuals from fully understanding how the product works, this is because understanding the product is essential for developers and innovators to come up with better products or more improved versions of the same product.
Critically, digital locks would be responsible for creating restrictions against individuals who wish to create a remix of a popular song (Sharma, 2018). It is crucial to note that the creation of a remix is vital for the improvement on the quality of the initial song as it opens up avenues for more artists to be more creative and innovative (Brock & Blackwell, 2012).
