Pettit v. State Board of Education
1.Do you believe the Board of Education violated her right to privacy? Were they justified in firing her? Explain two to three (2-3) major reasons why or why not.
The board of education violated Pettit’s privacy in the fact that they exposed a part of her private activities that she did not want to involve the public in. she had managed to separate her private life with her public life, until, there was a surreptitious intrusion of her privacy. This is an aspect that speaks to the issue of surveillance of one’s private life and the fact that, putting out the information in the public domain further dents the image of the person in question, to whom the information is related to. The board was justified in firing her relative to the fact that, prior to the information about her sexual activities being leaked into the public domain, she had never been found to perform poorly in her duties ("Pettit v. State Board of Education", 2016). At the same time, she did not at any one time involve the students or her colleagues in her private activities which would have been unprofessional. Instead, she professionally handled her duties at the school with dignity and adeptness that all of her performance reports were positive. This is a crucial aspect to consider relative to the fact that, if in deed she had involved any of the students, it would have been considered unprofessional and in fact a misconduct. At the same time, none of her private activities had been seen to affect her duties at one time, whether in delivery or even missing out on the duties all together (Reimer-Barry, 2016). Instead, she had managed like most people to keep her private affairs in order, such that they did not in any way affect the way that she taught or guided her students or further on the way that she interacted with the rest of the staff.
2.Was Pettit’s behavior unprofessional or immoral? Do you believe she was unfit to teach? Provide a rationale for your position.
There is nothing about having sexual practices at her age that was immoral. By any standards she was of an adult age and she and her husband had agreed to the sexual encounters at the swingers’ party to try and improve their marriage and keep it interesting (Reimer-Barry, 2016). one of the aspects that comes off from this scenario is that, both her and her husband and further all the persons that were at the party were adults. It is also crucial to consider that the teacher had managed to keep her sexual life private. This meant that she did not let in the other teachers or the students on her sexual activities ("Sexual Orientation Discrimination in the Workplace - FindLaw", 2016). Other than telling the rest of her colleagues, she did not also encourage them at any one point to join her at the private parties. This was also the children ("Pettit v. State Board of Education", 2016). As such, she had managed to separate her private affairs with her professional duties.
