To access the case study, go to McGraw Hill Connect (note you will need to launch McGraw-Hill Campus in a new window).
Select "Connect" to the BUS 641 Resources.
Click on the "Library" tab.
Then click "Student Resources." You will then be taken to the McGraw Hill Student Resource Site.
In the left column, select "You Be the Judge." This will bring you to a list of video case studies for the course.
Click on Case Study #7 to get started on this week's exercise. When you are finished, click "Print."
In your printer settings, select "print the page to PDF" for submission.

Issue: is Mr. Willy Ferrucci entitled to damages caused by Mr. Dominique Douala due to a breach of contract to record his album since the agreement was verbal?
Rule: the defendant Mr. Douala does not owe the plaintiff any money, he is not entitled to pay the $ 700 as alleged by the plaintiff. The two did not have a common understanding of the terms and condition of the project to be undertaken. If the plaintiff had a written agreement, the defendant would have breached the contract agreement by not paying the agreed amount after the album was recorded. The defendant could have breached the contract agreement if he signed a written document that clearly stated the terms and condition of engaging Mr. Ferrucci's services. Even though the agreement was verbal, Mr. Ferrucci could have proof of their telephone conversation or the voice message he left on for Mr. Douala.
Analysis: some of the facts in this case, is that out of friendship, both the defendant and the plaintiff worked on assumptions. Mr. Ferrucci charged Mr. Douala a reasonable price, but there being other side projects, Mr. Douala assumed that he was engaged in these other projects as a way of paying back Mr. Ferrucci since he did not have much money. Mr. Ferrucci did not attempt to extract a promise from Mr. Douala to pay him .Mr. Douala did not agree that he was going to pay for $ 700 for the project.
