There are loads of issues to consider first before jumping into creating a business. As McLeod Company, we have to ensure we create an efficient business structure. There are some legal and ethical implications that we have to consider the business structure. This paper will give more insight on the legal and moral issues.
Legal/ethical in B2C and B2B websites
When starting an online business or company marketing, McLeod company has to have a clear idea of what category the company will fall in. All online companies fall under international corporations and by extension have to adhere to regulatory guidelines put in place. Business-to-business (B2B) refers to online marketing where businesses exchange products and services against each other rather than dealing with consumers. Business-to-consumer, on the other hand, relates to the exchange of goods and services between a business and its customers (Andreini & Pedeliento, 2013). The legal and ethical issues of the two are somewhat different since they are two separate entities with two distinct markets.
Regarding privacy, B2B privacy issues are actively enforced for the protection our business partner’s information through the Professional Web Service (PWS) entity. Breaching the business partner’s sensitive information is an offense that can attract legal suits to our side. The B2C privacy issue majorly dwells on the consumer data found online. In the United States, there are no laws for consumer’s data protection; Ethics significantly protect client’s data. There are rules in place to govern Intellectual property and confidentiality matters when it comes to marketing regulations of both B2B and B2C (Badiei, 2015).
Online trust and online advertising Laws
It is very hard to put one’s faith in other business reviews and information over the internet. Some online businesses have a way of inflating their scores to attract other companies and consumers. A company may decide to post their positive reviews on their first page of their website and intentionally omit any negative reviews to win trust the trust of a new client. Some even go a step further to soil the internet site of their competitors with bad reviews just to ensure their continued dominance (Badiei, 2015).
There are several Acts of laws in place that provide legislation to govern online advertising. Section 5 of the Federal Trade Commission Act Clearly deems any deceptive acts impacting negatively on commerce as unlawful.
