When deciding on the cases that involve the Equal Protection Act, there are three standards that it applies. In the first standard, the court conducts strict scrutiny, so as to determine if at all the classification that has been challenged has any shred of interest to compel the state, in which case the government must be in a position to show. The standard is supposed to help classify the suspect and all the rights that fundamental and burdening. This standard is important as it helps the court to classify the suspects according to their race and origin nationally (Cheeseman, 2012). The classification also attends to the aspect of religion under this Act or the Establishment Clause. The aspect of aliens may be classified under this clause or under the third standard if there is the exception of political communities. On the other hand while classifying the rights that are fundamental and burdening, the court uses the following; it has to assess the vote dilution or it denial, the aspect of migrating through states, the courts access as well all other fundamental rights that are recognized.
