The Balfour Declaration as well as the Mandate of the League Nations was the initial international sanctions affirming recognition of the right of Jewish to have a homeland. The Zionist movement also called for the establishment of Israel as a Jewish state, but faced stiff opposition from the Arabs. This paper highlights on the significance of Declaration of the Establishment of the State of Israel, Resolution 181 and the country’s constitutional framework in establishing Israel.
Resolution 181 was an important document in the creation of the state of Israel, with both Arabs and Palestine being urged to accept the partition of Palestine in a non binding resolution. As such, the emergence of the Jewish statehood and an Arab State was clearly envisioned. PART 1 (A) provision 3 of Resolution 131 focused on a Special International Regime for the city of Jerusalem and establishing independent Arab and Jewish states. Despite the state nation having been in existence for more than six decades, there is still is opposition to the recognition of the state of Israel by Arab states. On the other hand, it could be argued that the interpretation of Resolution 181 which calls for a Jewish and an Arab state provides a basis for determining the boundaries of a Palestinian state.
The Declaration of the Establishment of the State of Israel was another important document for the establishment in the nation state of Israel. By acknowledging the shared history of the Jewish people, the document, set the tone for the recognition of Israel as a nation. The historical context also delved into legitimizing the connection of Jews with Palestine as previously pointed out in the Mandate of the League of Nations. Equally the General Assembly Resolution in 1947 provided a basis for the leaders of the National Council to proclaim the establishment of the state of Israel. This illustrates that Israel is a special place as it was intended to be a Jewish nation state, with shared Jewish history for those occupying the land.
Even though, the Declaration of independence merely expressed the country’s vision it was as important as the country’s constitution. One of the most important provisions in the Declaration is that it formally started a new chapter following the termination of the British mandate over Israel, allowing the nation to exercise self determination. One of the most important principles that have been integrated in Israel’s legal system is on the equality of all people regardless of their religion and background. The court has many at times relied on the principle as provided by the Declaration to ensure that there is no wanton discrimination for the minorities in the country.
The state of Israel identifies with the Jewish identity, but it is also a multicultural society, given that the General Assembly the partition guaranteed that the minorities would be protected. This extended to the use of any language with all citizens allowed to use their language of choice in public meetings.
