1. What is employment-at-will? Be sure to refer to your lecture notes when answering this question. (2 points)
Employment-at -will means that an employee can be fired at any time for any reason, apart from reasons that violate the laws. There are certain reasons why your employer can not fire an employee such as to discrimination or harassment in the workplace.
2. Describe the performance issues with (a) Phil and (b) Terry. (5 points
Phil had previously been a call manager, but was then asked to work with technology people, while there was no longer need for a call center manager after acquiring the catalogue company where Phil worked. Furthermore, when Phil disagreed with the CEO he did not use the best approach and since his performance was below expectations, he did not always get positive reviews as he had no clear role in the team. Similar to Phil’s case Terry’s performance is bad because there is non-alignment of skills and job requirements, and eave as he went through the regular hiring process he did not leave a good impression, and his connection with the management likely influenced the choice of hiring him.
3. As the manager, how would you handle (a) Terry and (b) Phil? In other words, would you fire Terry/Phil or would you do something else? Describe the rationale behind your decision for each employee separately. What are the important aspects of the manager’s decision for each employee? Review any relevant legal, ethical, political, economic, and other considerations. Think carefully about the legal implications of the manager’s decisions (refer to material from Chapter 10 and Chapter 3). (12 points)
