Proper interpretation of Shane’s re-evaluation results, it is evident that the student has received important benefit from the Free Appropriate Public Education (FAPE). He has received education services that are specialized to meet his needs according to the general curriculum. According to the term reports Shane behavioral issues have improved through the use of positive behavioral intervention services.
Several legal battles between the parents and various states have occurred over the years. The most common case on FAPE was between the Board of Education of Hendrick Hudson central school District v. Rowley(1982). The plaintiff, Rowley’s parents, sued the school that the school didn't assign an interpreter to their kid and hence their child could not gain maximum benefit of the general curriculum. The school defended themselves that according to the earlier Individualized Education Program (IEP), it got into an agreement with the parents. The school assigned an interpreter for Rowley, and after two weeks the sign language interpreter reported that the student did not require his services as he was able to read lips and recommended that the student uses the listening machine. The court ruled for the school; the court findings exhibited that the student received FAPE as per the individuals with the disability act.
J.L v. Mercer Island school district the court ruled that the school need not specify the minutes of instructions if they are reasonably known to all the parties involved in the individualized education program. The plaintiff lost the case as they failed to set a plausible argument that the school violated the IEP that they claimed to have denied the child access to FAPE (Wash, 2006).
State and Federals laws regarding the FAPE and parents participation at the team meetings indicates that the parents have a parental duty and rights to be involved in their children individualized education program. Parents should participate in the planning, decision-making and homeschool collaboration in all the aspects of their child's education program.
