The petitioner, in this case, Gerald Mitchell, was arrested for drunk-driving. At the very moment of his arrest, his blood alcohol concentration (BAC) was three times the state’s limit. He was driven to the station for a more reliable breath test. It was a mere standard procedure that warranted the use of evidence-grade equipment. On his arrival, Mitchell was lethargic for the breath test compelling the officer to initiate a blood test in the nearby hospital.
By the time they got to the health facility, Mitchell was unconscious. The officer tried to wake him up, but Mitchell never gained consciousness. The blood test approved claims that he was drunk. However, Mitchell reproached the action claiming that it violated his Fourth Amendment; a clause that bars against “unreasonable searches” (Supreme Court of the United States, 2019). In the end, the court was less convened of his argument and he was convicted.
