On August 16, 2016, at approximately 20:43, officers responded to 111 Felony Drive in regards
to a white male bleeding from his face. The victim, Samuel Clark, was friends with a female,
Summer Breeze, who lived at 111 Misdemeanor Lane. Mr. Clark was walking to Ms. Breeze’s
residence approximately one block east of Mr. Clark’s residence. As Samuel Clark turned the
corner, he observed two white men approaching him. A witness, Alan Skittles, identified the
two men as Bubba Hurt and Skeeter Redrum. Both Bubba Hurt and Skeeter Redrum began
yelling at Samuel Clark for him to leave Summer Breeze alone and that it was the “last time he
put his hands on her.” It began to rain so Samuel Clark opened his umbrella and continued to
walk north on Felony Drive. Bubba Hurt shoved Samuel Clark from behind causing Samuel Clark
to fall to the sidewalk. When Samuel Clark began to pick himself up from the sidewalk Skeeter
Redrum kicked Samuel Clark in the face causing Samuel Clark to fall onto the street. While
Samuel Clark was lying on his back in the street Bubba Hurt began to kick Samuel Clark. In
response, Samuel Clark grabbed his umbrella and swung, hitting Bubba Hurt in his eye. As
Samuel Clark stood up Summer Breeze hit Samuel Clark in the side of his head with her shoe
rendering Samuel Clark unconscious. A witness to the incident contacted 911. Samuel Clark and
Bubba Hurt were taken into custody and transported to the hospital. Summer Breeze and
Skeeter Redrum were taken into custody and transported to the Police Headquarters. Bubba
Hurt died at the hospital and Samuel Clark suffered a permanent brain injury.

Introduction
This is a case of an assault and battery which involves four people, namely: Samuel Cark, Summer Breeze, Bubba Hurt, and Skeeter Redrum. This particular incident happened on August 26, 2016 (approximately 20:43). This incident took place at 111 Felony Drive, Happy Town, Georgia, 15486. There are three witnesses to the scene: Alan Skittles (store owner), Michael Smith (an employee), and Andrea Sianturi (a customer). The weapons involved in the incident include both an umbrella and a shoe.
Samuel Clark went to see Summer Breeze, but he was stopped by Bubba Hurt and Skeeter Redrum, according to Alan Skittles. These two men started yelling at Samuel Clark, after which, both Mr. Hurt and Mr. Skittles started to attack him by shoving and kicking. In response to the incident, Mr. Clark used his umbrella to attack Mr. Hurt, which affected the latter’s eye. Summer Breeze used her shoe to hit Samuel Clark in the head. This violent act by Ms. Breeze led to the unconscious state of Mr. Clark. With severe injuries, both Mr. Clark and Mr. Hurt were transported to the hospital, only to have the latter dying at the hospital, while the former had a permanent brain injury based on medical tests conducted. Mr. Redrum and Ms. Breeze were also transported to the police headquarters.
This paper aims to identify the most applicable criminal charges against the involved individuals in the incident. Since this case happened within the jurisdiction of the state of Georgia, the basis for pressing charges to any of the interested must be the laws of Georgia. This paper would also like to determine the applicability of self-defense in this criminal case.
Applicable Charges
It was very evident that Bubba Hurt attacked Samuel Clark. He shoved and later on, kicked Mr. Clark. With the physical nature of the committed crime by Mr. Hurt, it is most likely that the criminal charge that can be pressed against him is Simple Battery. In the state of Georgia, the pure battery is an offense that requires physical contact. This includes harming the other party by punching, kicking, shoving, or even with the use of objects to hit the targeted person. The attack, however, should be intentional.
Additionally, the state of Georgia also considers touching or ripping off the other party’s clothes as an act of pure battery, considering that clothes are an extension of the victim’s body. This criminal charge can be convicted as a misdemeanor within the state of Georgia. The following are the possible penalties that could have been given to the offender: (1) one-year imprisonment; (2) S1,000.00 as a fine; (3) a combination of (1) and (2); (4) probation; (4) compensation for incurred damages, particularly the injuries resulted from harming the victim (criminaldefenselawyer.com, n.d.). These may have been given if the offender was still alive.
