The law consists of the rules governing society and is enforceable by the state via public agencies or in the court of law. For the efficient operation of a society, the law is paramount. The law gives different provisions for crime, torts, and dispute resolutions.
The mentioned cases pertain to the court system and how disputes ought to be dissolved. In case question 1, the steps required in a lawsuit are:
1 Commencement of complaint filing
2 Serving the defendant with process
3 Defendant responding to the complaint within a stipulated time
4 Discovery of relevant files
5 Filing of motion for summary judgment in material case facts are lacking
6 Designation of an expert witness.
Both parties should proceed with the case only when the pre-processing has been followed duly and the witnesses availed (Twomey et al., p21-22).
In case question 2, mandatory arbitration involves the statute's requirement that certain kinds of disputes have to be submitted to arbitration. Contrastingly, voluntary arbitration requires statutes that merely control arbitration when both parties in a dispute agree to submit their dispute to the arbitration (p27).
In case question 3, mediation entails the dispute's settlement by the messengers who carry to both sides the latest settlement made by the other party. At the same time, arbitration involves resolving a disagreement, whether of fact or law, by arbitrators and the parties agreeing to accept the decision (p28).
