Law ensures the smooth running of a society. The following tenets of law have been discussed below in detail: crime, torts, court system, and dispute resolutions.
Under the court system and dispute resolutions, case question 1, requires the steps to be followed in a lawsuit. They include the filing of the complaints, service of process to the defendant, the defendant's response and pleading, the discovery of required files, motion for summary judgment, and an expert witness's designation. A case can only proceed after all the requirements have been availed, including the witnesses (Twomey, Jennings and Greene, p21,22).
In case question 2, mandatory arbitration requires statutes that certain types of disputes have to be settled through arbitration. In contrast, voluntary arbitration allows the parties involved in a dispute to choose to resolve their disagreement by arbitration after filing a lawsuit (p27).
In case question 3, arbitration encompasses resolving a conflict, whether of fact or law, by arbitrators in which the parties agree to accept an outcome. On the other hand, mediation entails resolving disputes by a neutral person, one who gives the latest settlement made by the other party to both sides (p28).
In case question 5, Jerry should step down from jury duty, for he might be biased during the case as it involves his supervisor at work.
In case question 8, Esmeralda can choose arbitration or even appeal the verdict in a court with appellate jurisdiction.
