The sexual harassment problem is rampant in workplaces and organizations globally. Different nations have enacted laws and taken specific measures to deal with the problem. There have been numerous cases reported of sexual harassment claims in various organizations and workplaces across the US in recent history. According to the US Equal Employment and Opportunity Commission (EEOC), there were more than 7500 sexual harassment claims filed in 2018 alone, a 14 percent rise from the claims reported in the previous year. The recent wave of sexual accusations has forced various states to enact protection policies beyond federal regulations to curb the problem. For instance,47 states have prohibited sexual discrimination at workplaces. Eight states require that employers train employees on issues of sexual harassment in their workplace (EEOC). Uber, the ride-hailing company is also facing the problem of sexual harassment claims. An article by BBC world news published on 6th December 2019 showed that Uber had 6000 US sexual assault reports in 2017 and 2018 alone. The safety report released by Uber in 2018 indicated that 3,045 sexual assaults occurred within its trips in US. Customers accounted for half of the sexual assault claims reported. However, the company has a culture of sexual harassment and retaliation against individuals who complain (EEOC). Uber is also faced with a lack of diversity in its current workforce, whereby the majority of its employees in the US are mostly white with other races only occupying a very low percentage. Therefore, the paper seeks to address claims of sexual harassment, flaunting employment law, EEOC affirmative action, diversity of the workforce, and the legal provisions of ongoing cases.Employment Law
The investigation by the EEOC found reasonable cause in the case of Susan Fowler’s sexual harassment allegations contrary to Title VII of the Civil Rights Act of 1964. The act prohibits employment discrimination based on sex. It provides a legal framework for analyzing sexual harassment claims. Uber hired Eric Holder and Tammy Albarran, partners at Covington and Burling LLP (“Covington”) to investigate the claims of sexual harassment in the company. The investigative report indicated a myriad instance of sexual harassment of employees by the executive. Therefore, to settle the case, uber agreed to establish a fund of $4.4 million to compensate anyone who EEOC proved to have experienced sexual harassment or retaliation after 1st January 2014.Type of Harassment
Ms. Fowler faced sexual harassment from her manager, who solicited sexual favors contrary to the required code of behavior as stipulated in Title VII of the Civil Rights Act of 1964.
