5.3 A person is said to have acted negligently if he has departed from using ordinary care that a reasonable person would use under similar circumstances. For a defendant to be awarded damages due to negligence in a court of law, the plaintiff must prove that all elements of negligence existed. In this case, the automobile club of Southern California published the tour book and had no duty of care to the guests of the hotels. There is no duty upon the automobile club to publish a motel or hotel that is accident proof and in any case Yanase was shot in the parking lot adjacent to the motel so no the Auto club is no liable (George, 2007).
