Golightly entered an agreement with Rusty Trawler, the general manager of Mercs, after meeting in January. During all the meetings that were held to discuss Golightly's signing, he and his lawyer were not informed that the league had been added another two extra games. The contract indicated that The Player agrees that he will play football during the term of this contract and will engage in activities related to football only for the Club and will play for the Club in all its Conference's
scheduled and playoff games. After Golightly started playing in the team, he discovered that the other two extra games were added, adding to 16 games instead of the agreed 14 games. He immediately claimed that he was not going to play with the agreed payments. On Berman's side, he advised that the contract to be put aside and organize a renegotiation.
In contract laws, there is an element known as consideration, and it is the one that is used in identifying the source of the issue in a contract related case. Consideration analyzes the case together with the contract which the parties had entered in and identifies the missing items and the violated terms. In court, the judge looks at the consideration to come up with a judgment that is not biased. After carrying an analysis of the case, each side of the parties is critically engaged, and the issue is identified. Without consideration in the contract, the case will be hard to determine; hence it is vital in every contract.
In our case, Rusty Trawler, on the first place, did not inform Golightly that there were other two extra matches to be played in the league. The amount they had agreed on was only for 14 matches, which was why he complained. Golightly, together with his lawyer, was supposed to be involved in the determining of such a decision concerning the matches. Rusty Trawler refused to inform them about the other matches meant that he knew and had hidden intention. This is against a coach's ethics, especially during the time of signing a new player.
