Case Study Instructions:

In this project, you will analyze a court case involving medical malpractice. Using your analysis of the case, you will address the facts pertaining to the medical standard of care, breach of care, and causation. Further, you will use the facts from the original case to identify an ethics issue, determine an ethical theory that would help provide a safe and quality healthcare experience for the patient, apply a clinician–patient shared decision-making model, and augment or vary the facts of the case to change the outcome.
You will use the following case to analyze for Final Project I:

Specifically, your case study must address the following critical elements: I. Introduction:
A. Summarize the selected case, including information on the stakeholders involved, the problem, and the time period the incident occurred.
II. Medical Malpractice Component: In this section, you will evaluate the case to address the legal components, the malpractice policies similar to this case, and the standard of care given to the patient and how it was breached. Then, you will draw connections to how this malpractice case impacted stakeholders and healthcare consumers outside of the case.
A. Explain the key legal components of the case, including the nature of the issue and the rules that applied.
B. Determine relevant malpractice policies in place for addressing the issues within the case.
C. Analyze the malpractice case for the standard of care provided to the victim. Be sure to apply what the law states about standard of care to
support whether or not it was breached in the case.
D. Analyze how the malpractice case would impact healthcare consumers from different cultural backgrounds. For example, would this case have a
similar impact on a person from a culture different from the one in the case? How could this incident change the views of these healthcare

Ethical Component: In this section, you will evaluate the case to identify the specific ethical issues and determine ethical theories and shared decision- making models that would help resolve the issue and provide a safe, quality healthcare experience. Then, you will propose and defend ethical guidelines for healthcare providers to follow in order to avoid future incidents.

Introduction
The medical malpractice case is between plaintiff Arturo Iturralde and caretaker/daughter Rosalinda and defendant Hilo medical center USA that was decided on March 30, 2012. The case is about the defendant implanting the wrong materials in the plaintiff's spine. The defendant implanted screwdriver shafts into the plaintiff's spine rather than metal rods which caused complications and death. The defendant lacked the aspect of professionalism as the right equipment would have been used. From the case, the defendant was ignorant since the nurses' advice was ignored, and the plaintiff's family was not informed of the happenings to their patient. The activities conducted by the defendant were unethical and unprofessional.
Medical Malpractice Component
Medical malpractice, in this case, involves the defendant implanting the wrong materials in the plaintiff's spine. The defendant was supposed to implant metal rods in the plaintiff's spine but used screwdriver shafts. Hence, the legal component in the case is the breach of duty. The defendant failed to abide by the standard of care by implanting the wrong materials despite advice from the nurses. In most cases, the breach of duty does not require a sworn statement to be considered by a court. The breach of duty is unethical and unprofessional for people working in the medical care sector.
Different malpractice policies such as negligence and not seeking consent when doing procedures are in place when addressing the policies for this case. The case had high levels of negligence as the defendant used the wrong equipment implanted in the spine. The policy of negligence requires that medical professionals must act following the law and set standards (Dumitrescu, 2019). It is a case of negligence as the defendant failed to use the right equipment despite advice from the nurses. Equally, the defendant did not seek consent when doing the procedure. The policy on consent needs all the required procedures to be followed accordingly to avoid malpractice cases.
From the malpractice cases, there was substandard care provided to the victim. The defendant was aware of the repercussions of implanting the wrong equipment in the plaintiff's spine. The law on standard care requires that health care professionals provide care that is within guidelines and should be ethical (Dumitrescu, 2019). Standard care helps avoid malpractice cases since proper guidelines are followed to handle the patients. It is the standard of care in the health care sector that sets standards to be followed by professionals. From the standard of care, it can be concluded that it was breached in this case.
Health care consumers are likely to be negatively impacted by the malpractice since the experience is horrifying. Medical malpractice does not rely on one's culture, as health is universal. Medical malpractice, in this case, would change the views of health consumers as they see themselves to be in danger while receiving health care services.
