Background
The case between Rowley and the Hendrick Hudson District was argued in 1982 March 23 and decided the same year on June 28. The case involved (Amy Rowley) who was disabled as she had a minimal residual hearing and thus considered deaf. Before joining school there was a meeting held to decide on services needed to supplement her stay in the school. She was offered: use of FM hearing aid, a sign language interpreter, and sign language instruction for several administrators, to be placed in the general education kindergarten and teletype machine for parental communication (Hendrick Hudson Dist. Bd. of Ed. v. Rowley, 1982). Although Amy completed her kindergarten successfully, the assigned interpreter is observed working with her for only two weeks and then claimed that Amy no longer required his services. During the annual IEP, it was proposed that Amy should get supplementary tutor services that are inclined to the deaf; she was also to continue with the FM system and speech therapy at least three times a week. On this period, Amy's parents wanted to have the interpreter back on the given supplementary package. During a consultation with the area districts committee in charge of the handicapped a conclusion was made that there was no need of the interpreter. Amy's parents requested a due process but the hearing officer agreed with the district that there was no need of the interpreter. Again, the New York Commissioner of Education affirmed the same position on appeal the parents placed. Amy's parents sued the action to the federal district court, which found that Amy was doing better than average as she was well adjusted but she was not doing as much as she ought to without her handicap. Thus, they found for the Rowley's (Hendrick Hudson Dist. Bd. of Ed. v. Rowley, 1982). The Hendrick Hudson School District not satisfied with the ruling they appealed on a second circuit. The United States Court of Appeals on a second circuit did sustain to the lower court's ruling in a divided decision. A petition of certiorari was requested by the board of education and case was sent to the United States Supreme court.
