This paper examines regulations and laws which influence HRM functions and decisions of McDonald Inc.
Overview
Sloan (2014) says that McDonald’s started as a small barbecue restaurant that was established and operated by two brothers (Maurice McDonald and Richard McDonald). Since then McDonald’s experienced growth and expanded globally. However, despite such great success, in the few previous years, the organization has made headlines regarding its poor employment practices.
Analysis of the state of Wal-Mart’s legal issues in HRM future recommendation
What are the key employment law issues Wal-Mart faces?
McDonald’s reputation has been tainted negatively because of criticisms leveled against its employment practices. The company has been accused of violating labor laws by imposing unfair deductions on workers’ wages, declining to pay workers overtime compensations, refusing to increase minimum wages, denying workers rest breaks, forcing workers to work until late hours, threatening workers who seem to be against unfair practices, failure to enforce basic safety standards, involving in employment discrimination, and denying workers’ unionization (Cihon and Castagnera, 2016). All these were unfair labor practices that violated federal and state employment laws. For several times, workers have held protests and filed lawsuits against McDonald’s.
How the Company Understands the Legal Environment that Impacts HR Function
McDonald understands the legal environment which impacts HR functions since it has HR professionals who guide the company on HR matters. The organization claims being guided by high standards of ethics and legal frameworks and argues that it has been complying with legal requirements in foreign countries where it operates its restaurants (Steve and Hazen, 2012). However, the level of complaints, protests, and lawsuits against McDonald reveal that the company has not been complying with legal requirements.
How the Company Resolves Its Employment Law Issues
McDonald remains determined to overcome accusations leveled against the company by working hard to demonstrate the company’s integrity. Last year, the company made crucial measures to address labor issues. First, McDonald increased minimum wage pay to resolve employees’ demands for a wage increase. Secondly, McDonald approved workers’ unionization to allow workers to join trade unions and use such unionization to air their grievances. Thirdly, the company agreed to provide overtime pay and also accepted to give workers rest breaks. Fourth, McDonald improved employment terms by agreed to pay wages based on workers’ performance; implying that those who perform better would earn more wages (Kieman, 2015). The company argued that it has even enforcing basic safety standards and has ever been embracing workforce diversity without discrimination or unfair termination. The company made swift changes to solve labor concerns and respond to workers needs. McDonald recently made all these commitments to restore the organization’s reputation.
