Sexuality refers to the behaviors, feelings, attractions, and thoughts toward others. In particular, it entails who an individual becomes attracted to and whether one identifies as bisexual or heterosexual. The government or society regulates sexuality by discouraging various behaviors that might transgress people’s social values and norms. In most cases, heterosexual is the most acceptable form of sexuality allowed by many governments. The state uses the judicial system and the law enforcement authorities to implement and enforce rules against behaviors that might jeopardize sexuality. The government or society regulates sexuality through the judicial system, campaigns, humanitarian moralism, worker-citizen empowerment, arrests, and establishing moral boundaries.
Nayan Shah (2005) portrays that the government relies on the judicial system and law enforcers to regulate sexuality in society. For example, in 1926, Chief Reynolds arrested Arjan Singh, a 45-year-old man, and Alexander Quinn, a 17-year-old boy (Shan, 2005, p. 703). After being taken to court, Quinn was charged with the crime of vagrancy while Singh was sentenced 5 years in jail after he pleaded guilty of sodomizing the young boy. In this scenario, the court gave Singh a harsh punishment to deter the crime of buggery in the future. Moreover, Quinn was charged with vagrancy, which might have contributed to making him a victim of sodomy. Through the judicial system, society discourages behaviors that might lead to sexual crimes. For example, in the early 20th century, the court hindered social interactions between Asian migrants and white adolescent males. Indeed, “situational homosexuality” took place when people of the same gender lived together without interacting with others of the opposite sex. For the judicial system to regulate relationships between foreign migrants and male youths, it established sexualized and racialized masculinity typologies (Shah, 2005, p. 704). Consequently, the government or society regulates sexuality by using the court to implement and enforce laws that discourage specific sexual behaviors.
The government or society can also regulate sexuality through public awareness campaigns, worker-citizen empowerment, and humanitarian moralism. For example, Paul Amar (2009) affirms that the Brazilian government used campaigns to end human trafficking (Amar, 2009, p. 513). Specifically, slavery facilitated the kidnapping of people so that they can serve in large plantations. The most significant point that one should note is that public awareness campaigns educate individuals, which enables them to make proper decisions. For example, when people know that engaging in unprotected sexual intercourse might transmit deadly diseases, they stop that behavior.
