Introduction
Law brings a sense of order in any place or in any kind of activity that may be carried out. Therefore, law comprises a set of rules and regulations that one should abide to or follow to the latter. Moreover, in some instances breaking a law might lead to certain penalties that one may face. Additionally in this field of law, there is the international law and the domestic law. They all have a common goal but also they differ in some cases. For example, international law is applied globally in a number of countries, whereas domestic law can only apply in a particular country. In this world, law is very important. Were it not be for law, there could be no order in many places since it is law that governs the people. In this paper I am going to discuss on the importance of law and more especially focus on the international and domestic law.
How does international law differ from domestic law?
International law tends to be more complex as compared to the domestic law. Hence there are some of the differences that distinguish these two types of law. Therefore to begin with, one of the difference is that international law is between two or more states that have come together while on the other hand domestic law is one that can only be exercised in a particular country (Evans, 2011). For example, law that is practiced in the court system of a state.
Secondly, in terms of enforcement, the international law lacks a common executive. Hence this makes it difficult for states to obey the court’s decision as this option will come second. On the other side, the domestic law consists of the three arms of the government: the executive, legislature and the judiciary. This clearly shows on how international law is weak as compared to domestic law. Therefore those who may not obey domestic law always face severe punishments.
When I compare the court systems, international law only has one court system which victims are taken for trial but on the other hand domestic law contains a number of courts in which one can be tried. International law also deals with big atrocities like massacres that may be faced by citizens of a country but the domestic law deals with even the small matters.
International law is not mandatory for nations as it is sourced from treaties and customs by a number of sovereign nations in comparison to domestic law that is mandatory for any nation in order to ensure that operations are carried out s...
