The term Elements of crime refers to all the aspects that must be clearly ascertained before classifying a particular crime under a given category (Maxfield et.al, 2009). It is important to observe that even though the suspect might have confessed to taking part in the crime, then the elements of crime must be laid bare. For the elements of crime to be confirmed, then one must be able to prove beyond reasonable doubts that the suspect in custody is responsible for the crime committed. In addition, one must ascertain that the suspect was in the right frame of mind and finally the suspect must attest to having taken part in the crime.
As a practitioner in criminal law, the terminology element of crime will play a great role in ensuring that the practitioner gets the facts right occasionally. For starters, the aspect of the criminal law practitioner fully understanding the concept of elements of crime helps him in identifying whether certain crimes were committed with intent or not (Maxfield et.al, 2009). Though this is debatable, it will go a long way in proving the culpability of the suspect.
The whole concept of elements of crime helps the criminal law practitioner to go about some of the trickiest aspects of law. If for example a situation arises, during which an individual is accused of having something in his possession (Maxfield, et.al, 2009). The practitioner should be able to establish if indeed possessing the tool contributed to the crime. In like manner, the practitioner should be able to rise to the occasion and release the suspect if he or she was accused of being at the wrong place at the wrong time.
